Hair Relaxer Wrongful Death Lawsuits Continue Filed Against Loreal And Others

Tuesday, February 14, 2023 - One legal website is reporting that the estate of a woman who died recently of ovarian cancer has filed a wrongful death lawsuit against the manufacturers of the chemical hair straighteners the deceased used for decades. "Representatives of the Estate of Gail Hamilton, pursuing claims against L'Oreal USA, Inc., its subsidiary Soft Sheen-Carson, as well as Strength of Nature, LLC., and Godrej Consumer Products, Ltd. in the U.S. District Court for the Middle District of Florida," according to AboutLawsuits.com (AL). The hair relaxer lawsuit alleges that the manufacturers sold their chemical hair relaxers to the woman who used them beginning in 1980 until her May 2016 diagnosis of ovarian cancer which rapidly led to her death. Attorney Rochelle Coronado alleges the companies knew of the toxic nature of their product but failed to warn her client. The lawsuit, according to AL, states, "Defendants negligently misrepresented and/or fraudulently represented to Plaintiff and/or the public in general that their Products had been properly tested and were found to be safe for their intended use despite that knowledge to the contrary." The lawsuits accuses Loreal and others of "callous, reckless, willful, depraved indifference to the health, safety, and welfare of the Plaintiff." The lawsuit joins dozens of others that have been organized into multidistrict litigation (MDL) to streamline various repetitive court procedures and administrative activities. The MDL judge will decide which expert scientific witnesses will be allowed to testify when the individual trials take place back in the state where they were originally filed.

Spokespersons for Loreal are confident that the allegations are false and told Reuters the company is, "confident in the safety of our products and believe the recent lawsuits filed against us have no legal merit." Loreal and its subsidiaries manufacture such hair relaxer brands as Paris Smooth Intense Ultimate Straight Shampoo and Conditioner, Paris X-Tenso Moisturist Hair Straightening Cream, Paris Advanced Hairstyle AIR DRY IT Wave Swept Spray, Paris Elnett Satin Hairspray Supreme Hold, NS Paris EverSleek Frizz Finish Oil-In-Serum, all of which have been named in other lawsuits. Various studies published in the National Institute of Health (NIH) and elsewhere indicate that women who use chemical hair relaxers at least four times per year have a 2-4 times greater risk of developing cancer of the female reproductive system. Women with uterine cancer, breast cancer, and ovarian cancer all alleged it was caused by using chemical hair straighteners and may be eligible to file a hair relaxer lawsuit claim.

Unfortunately, the caustic chemicals in hair relaxers include sodium hydroxide, another name for lye. Chemical hair straighteners also contain calcium hydroxide, lithium hydroxide, and guanidine hydroxide which break the protein molecules in the individual hair strands. Hair relaxers may also contain dangerous ingredients like mineral oil, petroleum jelly, and fragrance. These fragrances mask the nauseating smell of the lye and other chemicals. Chemical hair straighteners have been known to cause eye irritation and scalp burns.
