The Number Of Hair Relaxer Lawsuits Alleging The Product Causes Cancer Continue To Rise
A motion has been filed to consolidate chemical hair straightener lawsuits into multi-district litigation to firmly decide on the science behind the illnesses
Saturday, January 14, 2023 - More than 40 similar hair relaxer cancer lawsuits have been filed by Black women who allege that using popular, best-selling chemical hair straightener caused them to develop uterine cancer. Now that the National Institute of Health study linking using chemical hair straighteners to cancer has circulated through the beauty salon industry, we can expect hundreds more lawsuits to follow this year and next. As a result of a large number of cases against the same defendants alleging their product caused similar illnesses, the cases will likely be consolidated before one judge in multidistrict litigation (MDL), to avoid duplication of administrative and other procedures and to save the court time and money. According to LevinLaw.com, "A motion has been made to centralize claims brought through federal courts in multidistrict litigation (Case MDL No. 3060) in the U.S. District Court for the Northern District of Illinois. On November 15, 2022, a group of plaintiffs along with several hair relaxer cancer lawyers filed the motion to transfer these cases to a single court in the interest of streamlining the judicial process and ensuring similar outcomes across individual lawsuits." Multidistrict litigation is preferred to repeatedly try each case one by one when complex scientific knowledge is involved. MDL discover and Daubert hearings allow each side to present their best scientific expert witnesses for the judge to decide which ones will get to testify. At this stage in MDL, the defense is encouraged to offer a settlement if the plaintiff's experts are strong and convincing. Each side in MDL gets to select about three cases to serve as bellwether trials which can influence future negotiations.
Plaintiffs allege that certain toxic chemicals in hair relaxers are absorbed into the bloodstream through the skin and also by being inhaled during heat treatments. Several new and prominent scientific studies seem to back this up. Recently-filed lawsuits accuse L'Oréal and other makers of chemical hair straighteners of deliberately targeting Black women for their advertising and failing to warn them of the potential dangers to their health. Dark & Lovely, Olive Oil Relaxer, Motions, and Organic Root Stimulator are among the best-selling brands. It seems as if Black women use chemical hair straighteners more than any other ethnic group making them twice as likely to develop cancer. Beauticians that straighten and style Black women's hair are at an increased risk of developing uterine, breast, and ovarian cancer, and also of lung disease from inhaling formaldehyde during hair heat treatments. Studies conclude that the more one is around chemical hair straighteners, the more likely they are to be sickened. Experts agree that more than four hair straightening treatments per `12-month period may be dangerous to your health. Black women are also being injured by developing fibroid tumors that may require a partial hysterectomy to remove, leaving women sterile and unable to bear children. Such a terrible situation can cause life-long psychological damage and rip families apart.
